Terms & Conditions

 1. Contract of Hire 

All bookings for hiring Villa La Pagerie, Prospect, Carriacou, Grenada, West Indies, are subject to the acceptance in full by the hirer and all persons in the party of these Terms and Conditions established by West Indies Sunrise Estates (WISE) Ltd, the owner of Villa La Pagerie. Bookings can be made by post, email or through the website and would be deemed to be accepted once payment is received by WISE Ltd, the owner of Villa La Pagerie. 

2. Deposit 

A deposit of 25% of the total cost is required to secure your booking. Your booking must be made by email, through the website or by telephone (followed by written confirmation) and will be held provisionally for five days or until the full deposit is received by us, whichever is sooner. If booking is made 60 days or less before the rental commencement date it must be accompanied by full payment. Should we not receive your payment within five working days, then your provisional booking would be released. All payments may be made by internet bank transfer, electronic bank transfer, or local bank cheque. 

3. Confirmation of Booking 

Your booking is only confirmed on receipt of your deposit and confirmation will be sent to you by email stating the balance cost and due date the final balance is to be paid. 

4. Final Payment 

The balance will be paid a clear 60 days prior to the rental commencement date by internet bank transfer, electronic bank transfer, or local bank cheque. If your booking is made 60 days or less before the rental commencement date it will be deemed provisional for five days or until full payment is received, whichever is sooner. If we do not receive the balance by the seventh week prior to your rental commencement date, we shall be entitled to cancel the booking without prejudice. 

5. Form of Payment 

All payments prior to your arrival date must be paid by internet bank transfer, electronic bank transfer, or local bank cheque. Our bank is Republic Bank Grenada Ltd, Melville Street in St George’s, Grenada, and bank account details will be provided once the booking confirmation has been received by email. 

Payments made during the villa hire period will be paid locally in cash in US$ unless otherwise accepted.

Refund of the damage waiver deposit will be refunded to you by either internet bank transfer, or bank cheque at your choice. 

When arranging an international payment into WISE Ltd Republic Bank account in Grenada for the rental of Villa La Pagerie the Payee is responsible for the payment of any associated bank charges charged by either the Payee or the Beneficiary bank. When refunding the damage deposit due to you on completion of your rental, any associated bank charges charged by either the Payee or the Beneficiary bank will be paid for by the Beneficiary. 

6. Cancellation by Hirer 

All cancellations of bookings must be made in writing and notified to and received by WISE Ltd. no later than 60 clear days prior to the rental period. If cancellation is prior to this deadline the deposit will be refunded, less a 15% administration fee. If cancellation is less than 60 clear days before the first day of the rental period, the full rental cost is to be paid. It is advisable that insurance is taken out well in advance against cancellation. 

7. Alterations and Cancellations by WISE Ltd 

In the unlikely event that a villa becomes unavailable due to circumstances beyond the control of WISE Ltd, the hirer will be offered alternative accommodation if available or a full refund of monies paid at that time. In the event that no suitable accommodation can be offered then a full refund of monies already paid for the villa rental will be refunded. Any refund is restricted to the villa rental costs and we are not liable for any cancellation or administration charges for travel arrangements, etc. 

8. Amendment Charges 

In the event you wish to alter details of a fully confirmed booking within the 60 days period, there will be an amendment charge of US$40 per change in addition to any increase, if any, in the cost of the revised arrangement. Confirmation of the amendments must be sent by you to WISE Ltd in writing or by email. 

9. What is Included 

The villa rental includes the provisional charge of a housekeeping visit (at times to be advised, depending on the length of stay), electricity, gas, maintenance of swimming pool and garden. Any defects or deficiencies must be reported in written to WISE Ltd within 24 hours of your arrival. After this time, it will be assumed that everything is in order. For groups over eight guests, a US$ 290 overcharge is applicable. 

Potable water is supplied to guests during the length of their stay thru a refrigerated fountain supplied with 5 gallons’ water drums, on the weekly basis of one drum upon arrival. Additional drums may be ordered in town by hirer. 

Garbage removal is to be assured every day by hirer. Closest garbage area is located in the nearby village of Boggles. 

10. What is Not Included 

The villa rental prices do not include personal, travel and cancellation insurance, travel, transportation, airport transfers or any additional housekeeping requirements. Catering or supplying a cook are not included, still we may assist in arranging these services externally. There is a large TV screen at Villa La Pagerie to which your lap top computer may be connected, but cable TV is not yet available. There is no air conditioning at Villa La Pagerie but fans are available in the leaving room and in all rooms. Fans must not be left in use when guests are outside the villa. Our prices do not include the utilization of a 4WD car, but we recommend that such a car will be rent (we may arrange for such thru Customer Service) due to the remote location of the villa (5 to 10 minutes from the closest village or town). Access sloppy road makes it necessary to use a 4WD car when it rains. 

11. Occupancy 

Villa La Pagerie is fit for a minimal occupancy of two (2) persons and a maximal occupancy of twelve (12) persons. Only persons notified to WISE Ltd by email may occupy the villa. The villa cannot be re-let or sublet to any other group/party or individual without the written approval of the owners. 

No party, public or private, may be arranged and held at Villa La Pagerie. It is for the strict usage of the individuals who have been notified as established above. No additional guests are accepted, including activities such as bathing, fishing, socializing (such as drinking, breakfasting, lunching and dining). 

Under no circumstances may more than the maximum number of persons specified in the villa description, occupy the villa except by prior written agreement. WISE Ltd, or their representatives, reserve the right to charge a maximum occupancy charge of 10% of the total villa rental cost per person/per night for each person above the maximum number specified in the villa description or on the booking form, or admittance to the villa will be refused to the hirer and their party if they are in breach of this condition. 

Prior to accessing the pool on the deck, guests must use the shower, especially after a sea bath in order to eliminate sand and algae’s. Generally, after any sea bath, the beach shower on the beach deck is to be used. In case of sand or algae’s found in the pool at end of stay, an amount of USD 150 may be deducted from deposit. 

We do not accept animals to stay inside the villa and on decks, or on any of the surrounding grounds. Breaching this clause may draw immediate cancellation of this rental agreement and/or a financial compensation to be cashed from damage deposit. 

12. Hirer’s Responsibility 

The hirer is responsible for taking a reasonable care of the property and its contents. At the end of the rental period, the property and its contents, including all equipment, furniture, utensils, etc must be left clean and tidy which include the crockery and cutlery cleaned and stored in the appropriate cupboards. The hirer must ensure that the cooker, oven, fridge and microwave are clean. 

The hirer shall ensure that no member of the party engages in any activity in or around the villa and swimming pool which may cause damage, offence to the neighbors, pollution to the water or damage to the structure or filtration equipment, this includes unacceptable anti-social behavior. Animals around, barking or not, are prohibited (see above). 

The hirer shall also ensure that the barbecue is only used in the designated barbecue area. No fires are to be started for whatever reason within the grounds of the villa. Only beach furniture is to be used on the beach deck. All other furniture should be left in the house. No smoking is allowed in the house. No mosquito candles or coils are to be used.

Whenever leaving the villa, the hirer must close and lock all doors, windows and shutters, to prevent any thief or damage, that he will be made responsible for if such a requirement is not observed. 

13. Damage to Villa and its Contents 

Except in the case of normal wear and tear, the hirer will be responsible for making good any damage to the villa or its contents which has occurred due to negligence, wilful damage or irresponsible behaviour on the part of those occupying the villa or their guests. Such damage must be immediately reported to WISE Ltd or its representative. The cost of the replacement or damage must be paid for by the hirer to the owner via WISE Ltd. A damage deposit of US$500 (unless otherwise advised) will be held against damage to the property, furnishings, excessive cleaning requirements (unless unnecessary call-outs, including those outlined in section 12. above. This sum will be added to the overall transfer amount due before arrival or paid by cheque on the first day of the rental period, and will be released in full at the end of the rental once the property has been vacated and checked for damage. If paid by cheque, such will not be cashed and will be returned at the end of stay (once any damages have been paid in cash). 

14. Rights of Access 

WISE Ltd, their representatives or their sub-contractors have the right of access to the villa at any time with due regard to the convenience of the hirer for the purpose of linen changes, inspection of the property and to carry out any essential or routine repair or maintenance work in the villa or in the garden. 

15. Responsibilities 

Neither WISE Ltd nor their representatives can be held responsible for any circumstances beyond their control including, but not limited to, mechanical breakdown, illness, swimming pool maintenance, emptying of swimming pool for necessary maintenance, failure of any public service supply. The hirer responsible for booking undertakes that no person will suffer anything to be done which would endanger the policy of the villa owner’s insurers in respect of the villa and its contents which might make the same void or voidable. 

16. Injury and Damage 

WISE Ltd, the owner of the hired property do not accept any responsibility to compensate you and/or your party for any personal injury, illness, death, loss or damage of whatever nature suffered by you or any member of your party during the booking period or thereafter. We strongly recommend that you insure yourselves and your party for covering such risks. 

17. Accuracy of Information 

We take a great deal of care to make sure that the information and photography contained in our website is correct and reflects the reality. However, changes may be made from time to time at Villa La Pagerie, such as changes to details like decoration, furniture and fittings. 

All information supplied by WISE Ltd is given in good faith and is based upon information available at the time. All reasonable measures have been taken to ensure accuracy, but WISE Ltd and their representatives are not liable for any variation however caused.

18. Villa Arrival and Departure Times 

The villa will be available for occupation from 12.00am local time on the day of arrival and must be vacated by 15.00pm on the day of departure, unless otherwise agreed in writing by email. 

19. Keys, Directions and Local Contact Numbers 

Detailed instructions for key collection and directions to the villa will be sent two weeks prior to the rental commencement, together with a local contact telephone number of our close-by Customer Service Manager, would you have any problems whilst at the villa (24 hours hot line available). 

20. Complaints 

In the unlikely event that you have a complaint about the villa or its contents whilst on holiday, it must be reported immediately in written to the Customer Service Manager who will take reasonable steps to resolve the matter on behalf and in liaison with WISE Ltd, also to be copied. Neither WISE Ltd nor their representatives shall have any liability for any complaint submitted more than 24 hours after arrival or materialization, or after the completion of the hire period. Subjective opinions are not considered as a complaint. When a hirer chooses to leave a rental over a subjective issue, he does so taking responsibility for such a decision and no refund may be considered in this situation. 

21. Building Work 

In the unlikely event that building works would take place, arranged by local authorities, private developers or neighbors, please note that WISE Ltd could not be made responsible for any annoyance caused by such works, neither possibly affecting your stay. Still all would be possibly done in such a case to limit the annoyance as feasible. 

22. Force Majeure 

WISE Ltd cannot accept any liability or pay any compensation in such an unlikely event that the expected level of performance for our contractual obligations is prevented or affected by ‘force majeure’. In these Terms and Conditions of Hire, ‘force majeure’ means any event which we or the supplier of the service(s) in question could not, even with due care, foresee or avoid. Such events may include, but are not limited to: War, threat of war, civil commotion or strife, hostilities, strikes or other industrial disputes, natural disasters, fire, acts of God, terrorist activities, quarantine, epidemics, weather conditions, government action or other events outside our control. Please also see paragraph 24 below. 

23. Law and Jurisdiction 

This rental agreement is contracted between the property owner (WISE Ltd) and the hirer. Any disputes arising from the rental of the property will be resolved between these two parts. 

This agreement shall be governed by the laws of Grenada to which both parties expressly submit.

24. Insurance 

The villa rental established cost does not include any personal insurance cover of any kind. It is advisable that the renting party undertakes a travel insurance to be covered against cancellation risks and it is as well strongly recommended that a personal accident and medical insurance coverage is also undertaken by such renting party. Please also see paragraph 22 above. 

When booking Villa La Pagerie (by email or letter to WISE Ltd), the hirer or renting party acknowledges that it is their own responsibility to undertake any travel, medical and accident insurance judiciously covering all and any involved participants, in order to anticipate any risk of any kind which could occur during their stay at the villa.
